Builder gone bust - sub contractors want payment

    self build house, builder has gone bust and some sub contractors / suppliers want peony which he didn’t pay them but I have paid the builder for


    Do they have any recourse to take material off site etc ?

    Why are they contacting you? You didn’t employ them/order materials. I presume you have schedules and receipts from the builder.

    basically they’re chancing their arm. Presuming that there’s no contract between any of the subbies and yourself, and that they were employed by the main contractor, then they have no recourse.

    Be sure to lock the site securely.

    If you had a contractor it wasn't a self build. But as others have said they are just chancing their arm!

    OP if you had a single builder over the project then its the builder they follow not you. Alot depends on whether you are ahead or not in real terms which is highly unlikely. You are probably out of pocket as well.

    In certain situations it may suit to do a deal with a trade such as a electrician or a plumber who can finish and certify the existing work completed

    Alternatively, if it’s a self build then the OP is on the line for the trades cost.

    OP isn’t clear. Every post is speculating.

    People sometimes describe a house being built for them, rather than in a development as a “self build”, if you want to be pedantic, self build is where the owner organises all labour/materials themselves. In the op, it says, “the builder didn’t pay them” it is fair to assume, the op contracted a builder to build the house, who in turn employed subbies, as is the norm.

    If the Builder found/engaged the subbies, then it is the builder who is responsible for paying them, especially if the op has paid the Builder for the work done.

    Even in a self build if a contractor went bust that was doing the roof as an example the owner is not responsible for paying labour or materials he supplied.

    In a case like this the liquidator can purse the owner for any outstanding invoices owed but neither tge liquidator,trades or suppliers are entitled to anything else

    Cowboy looking to avoid his debts or responsibilities. Still plenty of them around. He'll be back out building and ruining peoples lives next week.

    The owner isn’t obliged to pay the contractors labourers, or suppliers. But if the owner was the one who sign contracts/orders/etc for the other trades (as in a self build) then they have every right to look to him for payment.

    If the cowboy was planning on burning people here, then he may set the owner up like that.
