Can anyone shed some light on the procedure for establishing reporting person's eligibility criteria in a Section 21A(2) request by the relevant court to the Prescribed Person or the Commissioner?

How does the prescribed person/the commissioner decide whether the protections of the law are applicable to a whistleblower but not to another whistleblower, when asked to do so, by the WRC of the Court?
