Illness Benefit & Employee/Employer

    Hi all,

I made a genuine mistake and had my IB paid into my [bank] account instead of my employers one.

I returned to work on the last date of sick cert and closed my claim as I was supposed to, all certs were up-to-date and I did NOT work and continue to collect IB.

I now found out that the IB that I received*was meant to be sent to my employer account.

I was on reduced salary which was hardly anything, I need the IB to pay my mortgage and bills, kids.

What can I expect now? I understand it has to be paid back to employer, how will that happen and will social welfare prosecute?

As mentioned, it was not fraudulent merely a mistake, I'm worried how this will effect my current employment..

    Thank 🙏🏻

*Off work for 4 weeks in total, so was around 800e paid to me in total.

Paying IB to your employer is a contract between you and the employer - Social Welfare won't prosecute.

Speak to your employer about repayment of what you owe them.

Illness Benefit don't care where the payment is issued as long as you qualify for payment so you won't have issues there. If you speak to your employer they will probably accept it via bank transfer but might need a statement of how much you got, which Illness Benefit can provide.

The other option is they might ask you to return it to Illness Benefit and have them reissue it to them directly... But don't suggest this offer to pay them directly first as it's much, much simpler to coordinate
