Is planning required?

    I bought my family home from my mother, she still lives with us at the same address.

    In the late 90s she built a 50sqm extension on the side of the house and got full planning permission for this extension back then.

    Now myself and my wife want to extend on to the back of the house, it would be just under 40sqm and we would still have more than 25sqm of a back garden.

    Do we need to apply for planning permission for this new extension at the back of the house as technically the "no planning required" for a build under 40sqm was ever used at this address?

    Does that make sense?

    Planning required. The 40m2 exemption only applies where the house has not been previously extended regardless of whether permission was granted or not.

    Yep 100 percent.

    The previous extension at 50 sqm even when granted permission wipes out any possible further exempt extension.
