New Build Wheelie Bin Issue

    Buying a ground floor duplex in a new build estate, haven't got the keys yet but I've contracts signed etc.

    I went for a spin around the estate in the last few days and noticed that the storage area for wheelie bins indicated in the submitted plans for the upstairs duplexes was not done by the developler. There was meant to be a small airated bin cupboard, but it looks like the developer decided to cut corners and didn't bother with it.

    As such, the wheelie bins for the upstairs duplexes are likely to be plonked full-time outside my front window along with my own. This is how things are working with the same unit types in the estate. 6 bins all cluttered outside the front of the sitting room window of the downstairs duplexes (8 if you include composting bins too). Apart from the access issues that this will generate, I'm pretty annoyed from a privacy point of view as well.

    Given that the bin cupboard for the upstairs was submitted as part of the plans and there was drawings indicating bins would be stored there as part of the waste management plan, do you think I'd have much joy with a planning enforcement submission? Do the developers not have to conform to the drawings and plans they submitted as a condition of planning?

    Anyone with a similar experience or advice? Pretty unhappy with this state of affairs.

    I would find the site manager and ask them first of all. If you're having a problem, then everyone with a ground floor apt will have a problem.

    OP I wouldn’t have much of a knowledge here but my brother is an architect and well used to this sort of stuff and I’ve asked him what he reckons.

    Try and resolve the situation with the developer first.

    If they don't play ball and provide the storage area as per. the plans report it to the Enforcement Section of the local authority Planning Department.

    OP, as per two points above the advice given was:

    First of all contact a foreman on site or look for site manager/project manager (if there’s still construction ongoing) do this in writing preferably not just verbally.

    If they ignore you contact them again and let them know if they development isn’t brought in line with plans you will need to contact council which you’d rather not but if it’s not sorted otherwise you’re left with no option

    Then contact council if all else fails

    worth noting he also mentioned if the estate isn’t fully built yet and they’re still adding houses to the phase you’re buying from (ie if you’re part of phase 1 but they’re onto phase 2 ignore what I’m saying) it may be the case they just haven’t gotten to them yet and haven’t just skipped the bin storage. That’s why it’s best to speak with someone on site about it first

    This is a good point. We had some issues with our place, I always text the site manager a summary of any conversation, just to have something in writing.

    yeah you’d have to sure- too easy for them to claim you’re codding otherwise and as it was put to me by my brother there these lads have too much money to be ever challenged.

    The only one they fear is the council 🤣

    that will be a hard requirement for the planning. Site manager first. Developer second. Don’t close without something in writing.
