    Smart Telecom's chief executive said that it is inevitable that ComReg will win its legal battle to ensure cost-effective and automated local loop unbundling.

    Eircom is currently taking ComReg to the High Court, appealing the communications regulator's decision to force the incumbent to streamline the process for local loop unbundling. Automated and low-cost unbundling would allow people to switch to competing broadband products quickly, without interruption to their phone service and without having to change their phone number.

    The vast majority of the more than 100,000 ADSL broadband users in Ireland are using Eircom's bitstream DSL product, regardless of whether they buy it directly from Eircom, or from one of Eircom's competitors, who act as bitstream DSL resellers.

    Speaking to ElectricNews.net, Oisin Fanning said that although ComReg's battle with Eircom may be on a specific point of law, regulators throughout Europe had already fought this battle with the incumbents and had won.
