I think he's taking defensive driving to the "Ultimate Level". If someone steps out from behind a truck and you hit him, he, if not dead, might be able to argue that you, the driver was going too fast, not paying atention, was too close to the left side yadda yadda yadda.

Of course some of that might be true, but its also true some berk stepped out without looking.
