not because of "the econemy"... because Ireland doesnt have a monopoly law. If only we did, Then the countrys internet services wouldnt be in such a state..

    we actually do,
it not that, its local calls, if they had remianed free(thank the goverment for that brainwave) then we would have followed the us very closely, we would have one of the highest levels of net use in euro instread of nearly the lowest. companies would be fightign to offer broadband in every major city, and we would actually be an e hub.

    Irish Monopoly Law:

    "The monopoly belongs to Eircom"

    Tizlox...

There are numerous safeguards in Irish Legislation and other International Agreements of which we are signatories including The Irish Competition Authority, Countless EU Regulations, namely Article 81re: Anti-Competitive Practices and Monopolistic Behaviour and the GATS Agreement(General Agreement on Trade in Services) as incorporated into World Trade Organisation Law.

So we do have anti-monopolistic measures in place that do work in most sectors. Thats not to say €ircom are not acting like a monopoly given their abuse of a dominant position, but we do have (a largely effective) "Monopoly Law":)

Has Eircom ever be taken to court with the power of this law ?

Who has to issue a case aginst them ?

    Simple answer...No!

Althougth the recent price dispute in the High Court with the ODTR was a watershed.

It doesn't look likely either that the EU are going to get invloved given the non-inclusion of Ireland in any writs by the EU for no LLU- That was announced just before christmas- there are 3 countries- cant remember who right now.

I've thought about various potential writs but....
    1- they are very theoretical
2- prolly wouldn't make it to the ECJ until 2006:(

    Heres one of them...
