    The Communications Regulation Bill, which win expand the powers and functions of the telecommunications Regulator, now contains much more stringent sanctions for licensing breaches, the Minister for Public Enterprise, has told the Dail.
    Speaking during the Bill's second stage, Minister Mary Q'Rourke outlined how the maximum fine for breaches of licensing conditions had been increased from EUR 1,900 to EUR 4 million or 10 per cent of the operator's turnover, whichever is the greater.
    The Minister told the Dail "This represents a substantial increase in the maximum penalty for a breach of a licence condition, which currently amounts to EUR 1,900. I am confident that these provisions represent a significantly enhanced enforcement mechanism which will enable the new Commission to enforce it regulatory decisions in today's rapidly evolving communications sector."
    The main points of the Bill include proposals to transform the Office of the Director of Telecommunication Regulation into a three-person Commission, restriction of the powers of telecommunications companies to disrupt traffic flow by opening roads for cable laying and a significant increase in the powers of enforcement of the new Communications Commission.

    The Minister said that the expansion of the Regulator's office to a Commission reflected the massive growth in workload of the office and the increasingly complex nature of the tasks and rulings which had to be implemented.
    She added: "The communications sector is an important contributor to Ireland's objective of being at the vanguard of the information society and electronic commerce.
    In order to ensure that we have an efficient and effective communications sector we need to have a regulatory framework for the sector which facilitates ongoing industry investment, competition and service quality. "
