FREMONT - A Clyde woman claims a Wendy’s chicken sandwich "exploded" onto her face and hands and caused severe burns.

She filed suit against the fast food chain yesterday in Sandusky County Common Pleas Court.

In the lawsuit, Toledo attorney Samuel Bolotin alleges that a defect in the design of the chicken sandwich and the failure of Wendy’s employees to warn patrons of the risk of the sandwich’s exploding warrant a judgment against the company.

Mitzi Pumphrey is asking for no less than $25,000 from a jury to help pay for the pain and suffering caused to her and her family after she was "severely" burned by the sandwich. She and husband, Scott Pumphrey, are suing the company, the supplier of the chicken, and the "manufacturer" of the chicken.

According to the lawsuit, Mrs. Pumphrey bought the sandwich on May 22, 2001, from the Wendy’s restaurant in Clyde. She added that she was burned by hot liquid that spurted onto her face and hands after she bit into it.

Mrs. Pumphrey claimed she was forced to submit to X-rays, examinations, treatments, and therapies including medication, the lawsuit states. It charges that her family has been deprived of "comfort and happiness" as a result of the Mrs. Pumphrey’s injuries.

Wendy’s officials could not be reached for comment last night.
