Can a minister / taoiseach be removed from office?

    While reading about Bertie's and Charlie's exploits in De Paper earlier on, I began to wonder if it's possible to have, for example, Charlie McCreevy removed from the Cabinet? Or even Bertie from the office of Taoiseach?

    I know it's arguable, particularly given the weak election campaigns of the opposing parties, but there is a growing opinion that Fianna Fáil's deceit has contributed to them winning the election. So, if there was a case to bring, how would it happen? Could the Opposition bring a case against the Government? How about a citizen?

    Just curious.

    You mean a court case to remove Bertie? Definitely not. The Taoiseach can only be removed from office by a vote of no confidence in the Dail. This is the way it should be -- we don't want the courts getting involved in politics. Imagine an FF government packing the Supreme Court with party supporters, and then suing when they lost the next election. Instant legal dictatorship.

    From the Irish Constitution:
    The Taoiseach shall resign from office upon his ceasing to retain the support of a majority in Dáil Éireann unless on his advice the President dissolves Dáil Éireann and on the reassembly of Dáil Éireann after the dissolution the Taoiseach secures the support of a majority in Dáil Éireann.

    If the Taoiseach at any time resigns from office the other members of the Government shall be deemed also to have resigned from office, but the Taoiseach and the other members of the Government shall continue to carry on their duties until their successors shall have been appointed.

    The members of the Government in office at the date of a dissolution of Dáil Éireann shall continue to hold office until their successors shall have been appointed.

    Don't know about other laws though.
