900Mhz handsets. Legal or not?

I've noticed that there still seem to be a lot of these floating around with taxi drivers and on large sites, despite the fact that they were supposedly outlawed a few years back. Does anyone have a better idea of just how legal these handsets are, and is licensing available for this range without being a telco.
