How long will I be disqualified from driving?

    hi i am 17 years of age and have only had my licence 2 months. I was caught tuesday morning at 2.35 am by the guards outside the pub i was done for failing to stop no nct,tax,insurance,no qualified driver with me and no i was not done for drink driving. i am just wanting someone to try and tell me what would the fine be roughly, will i lose my licence and how long will it take for the case to go to court.

    A long time hopefully.

    Be a court summons with a hefty amount of fines I'd say, and probably 6 months driving ban (assuming you'll get at least 7 points on your license).

    Just to clarify - you don't have a licence. Driving permit is not a licence and it's only for purposes of learning to drive.

    I can't help with your question though as I have no experience in that

    I’ll assume you didn’t stop for them because you didn’t have any of the documents you mentioned. It’s not what you want to hear now but drivers like you don’t deserve to be on the road.

    Whatever about everything else, How did you think it was a good idea to drive with no insurance? Reckless towards yourself and other road users and in my opinion you do deserve some sort of a ban.

    We have an influx of troll(s) into this forum with dramatic tales of their outlaw lifestyles and their running-through-the-raindrops styles of derring-do. People always seem to rise to the bait and call them out. We don't want that here.

    We also have people who post about possibly genuine issues but other posters think that they can talk down to such posters and moralize to them. We don't want that here either.

    OP, for failing to stop and no insurance you will be hammered with large fines. Smaller fines for no tax, NCT and no accompanying driver. Expect lots of points and a disqualification.

    It will probably take 4 months or so to come to court. The instant you get the summons, you need to be talking to a solicitor, preferably one who regularly appears before the local traffic court. Don't even think of going to court without a solicitor for that portfolio of offences.

    The aftermath of this incident will be painful because with a conviction for driving with no insurance and your age and your lack of a full licence, you will have a huge problem getting insurance. That's after you come out of the disqualification which I expect you will get, especially when your offences include turning away from a checkpoint. I assume you did a u-turn and got intercepted, if you barrelled through the checkpoint and the cops had to jump out of your way, you could be looking at jail time.

    I assume OP was asked to stop and failed, otherwise its not illegal to avoid a checkpoint ahead, a moot point however given the other alleged offences

    OP said 'I was done for failing to stop' but whatever he did in attempting to avoid the checkpoint, I'm guessing that the prosecuting Garda will find some way to mention it to the judge in which case it may as well be a separate offence.

    Note taken, not a bravado, law evading story, but... A relative of mine had his NCT, Insurance, & tax discs robbed from his open top car. He didn't notice as he had the old discs stacked behind the new ones. It was noticed by a vigilant Garda at a checkpoint, but there wasn't a problem, he just had to produce the certs at his local Garda station within ten days and apply for new discs.


    So, if you were actually insured, NCT'd and taxed, but not displaying there might be a softer outcome.



    If you weren't insured, taxed or NCT'd you're most likely the the architect of a disastrous start in motoring life. Trying not to moralise here. :o

    In that case you could expect jail time, they could easily see it as attempted manslaughter , get yourself a good solicitor NOW.

    There's no such crime as attempted manslaughter. If you attempt to kill someone, it's attempted murder. If you kill someone through an act of gross negligence or recklessness, it could be manslaughter. In the OP's case where he drove his car through a checkpoint and the cop had to jump out of the way, it would be assault on a Garda plus dangerous driving.

    Throw in no insurance and the other stuff and he will be very lucky to avoid jail.
