Looking for a Solicitor to sign Affidavit of debt + Statutory declaration of service

    Hi,

    I am currently going through the process of debt recovery of around 6k via the District Court, against a company that pretty much is not paying me for goods sold to them (as a private). They have been scamming many people in the past few months.

    As per process I:
    1. Sent the final demand letter to this company.
    2. Sent the claim notice stamped by the District Court
    3. Waited 28 days.

    As the debtor hasn't paid I need to go to the next stage in order to apply for judgement, fill these 3 documents and take them to the sheriff:
    - Statutory declaration of service
    - Affidavit of debt
    - Judgment (decree) by default

    Now my question: as the first two documents (Statutory declaration of service and Affidavit of debt) need to be signed by solicitor and I don't have one, what is the best way to find one? My concern here is that according to what I have been told by the person at the District Court the fee for signing these documents would be very low, around 10€ each, and I am worried no solicitor would bother to even take time to do this. I emailed a few but got no response back.
    Is there an alternative way I can do this, like some public solicitor who can handle this? I just pretty much a matter of signing 2 documents and getting my payment.

    Most solicitors will do it. I've signed plenty for our management company and used two different solicitors, no problems with either (two was due to changed location)

    Thank you! I will contact a few more today and hopefully get a response. Given the current situation (Covid) do you think they will be able to sign these documents digitally, or only in person at their premises?

    I've done a few in lockdown and signed in person in an open area of the office building rather than the solicitor's office as usual.

    Unless there has been some recent change a statutory declaration can be made before a peace commissioner, no charge
    An affidavit can be sworn before a commissioner for oaths or any practising solicitor. Fee ten euro,
    In all above cases if you are not personally known in the office bring proof of indentity

    Any mention of Solicitor should also include mention of Commissioner for Oaths, both have the same signing power (for want of a better term) as regards Stat Decs and Affidavits. In practice it can sometimes be hard to get a Solicitor to sign a document wearing their 'witness signature' hat, as they may be inclined to wear their 'legal advice' hat.
    To find a Commissioner for Oaths just google "Commissioner for Oaths + YOUR TOWN NAME"
