A few posts in and the judgements are piling in. The OP asked a straightforward question, he don't have to justify to strangers why he is not vaccinated! I'm sure the "experts"will be along shortly with their science and graphs to explain why you should be vaccinated!

If you have only just renewed your membership, I'd look for a refund, if you only have a short time left on it, I'd leave it go.

I know someone in this situation, happy to be vaccinated but it's not exactly that easy. The GPs won't do it, the chemists won't do it. The HSE vaccine centres are preoccupied now with booster regime. It's a bureaucratic system and when people fall through the cracks, the system doesn't handle it well.

OP if it was a standalone pool, they would have an option. But I'm guessing it's a complex, so they are legally required to discriminate.

The public bit is really irrelevant: the same restrictions apply no matter who owns the facility.

Personally I am not happy to provide personal medical information to gyms, pubs etc. So am choosing not patronise these businesses while certs are required, irrespective of vaccine status. Am hopeful that the gym part, anyway, will be relaxed in January. I've yet to hear of an outbreak of Covid stemming from a gym, and there are a lot of elite sportspeople who have very good reasons for avoiding this particular vaccination.

What "very good reasons" would they be?

March? If OP got a shot next week they would have second shot and 7 day waiting period done before end of January if Pfizer received. Second dose is valid from 17 days but likely be closer to 21 days. You can add extra week if Moderna. Worst case its early February.

That's a very best case scenario for someone who is now suddenly motivated enough to get a jab in Christmas week. This cert measure is part of the fear over Omicron and is part of the package that includes entertainment and outdoor events. They will move on lifting that as soon as they can.

The T&Cs of the gym haven't changed at all. They are exactly the same as before. It's a government / health requirement & not a Gym membership requirement. There is a big legal difference between the two.

If the gym has any cop on they will extend his membership for the length of time the vaccine requirement is in place. This way OP wont lose out on any paid gym membership months. That's assuming they aren't suffering from long Covid by then

Er, no. The gym's T&Cs haven't changed at all. Government health regulations have changed. You can be sure that the owners would love to let everyone in. Vaccine or not. It isn't the gyms fault. Having said all that the gym should offer to extend the membership free of charge by the length of time that government regulations are stopping OP from attending the gym. A well run business would go further and throw in a few extra months free

Ask yourself what outcome you're looking for.

If that's access to the gym without a COVID cert, when a COVID cert is legally required, that's not going to happen. The gym would be breaking the law, and whatever your contract with them says, it can't bind them to do something illegal.

If you want your money back that may not be a problem, but take that up with the gym. Until they've refused there's no point in considering legal action to get a refund.

If your idea is that it's the COVID cert legislation which is illegal, your recourse is against the State. Good luck with that.

It is is logically impossible for the COVID legislation to be legal but the gym to be acting illegally in applying it.
