They legally had to give you a refund in this case but have had one case where I bought a game and it was so bad I asked for a refund and got it despite having downloaded and playing it for about 15 minutes. (Metal Slug Collection which was a PS2 port that ran at 50 FPS and was **** awful). Always worth chancing your arm.

The platformer holders might pretend that they don't have to but EU law covers refunds of digital products now and it's been tested in court so they have to give a refund on digital goods legally. They put in stipulation of not having downloaded the game or only played 2 hours of it and that's probably illegal under EU law for them to say this but it hasnt been tested in court of law.
