    They arent rally fans and dont even go out to the stages to watch. Could literally go anywhere in the country to do that shite but have to drag rallyings name through the mud every year, donegal is even worse.

    Would modifications to a car needing to be notified to your insurance company not be a civil matter, why are Gardaí being involved if the car is road legal as regards NCT and rules of the road?

    If the modifications would violate the terms of the insurance, or be something which would effect the insurance the company providing a quote or change the terms of the quote, technically its fraud as it breaches the principle of utmost good faith, and could void the insurance. So technically you could be legally uninsured which is what they'd be attempting to catch lads under.

    would an insurance company refuse to pay a third-party claim based on the first party's car being modified? because i assume it's third party cover the gardai would be interested in (given it's the legal minimum)

    Dont think so, sure they’d have to call the insurance company to confirm and they’d all be closed for the weekend.

    I saw on Garda Twitter a pizza delivery driver got done for no insurance because he didn’t declare his job. Thought that was quite strange.

    A note was probably taken at the time of the delivery driver being stopped that they were doing a delivery and to check their Insurance for whatever clause when it was to be produced.

    Wouldn't motor insurance be a private contract between the Insurer and Insured and therefore be subject to GDPR rules? So the Gardaí wouldn't be able to check the details of the policy without permission from a driver?

    You need to be insured for business purposes to do delivery driving, every standard domestic policy I have ever seen has a clause excluding use in connection with any business and or the carriage of any goods for any business.

    No. You could be driving a nitro injected henhouse, high as a kite on crystal meth and the insurance will cover third party damage. The insurers would have the right to seek recovery from the policy holder ie pursue them for reimbursement but in reality, this never happens.

    Probably, I'm not sure. But if I was stopped at a checkpoint, the only proof I would have is the disc, so I don't know how Gardaí at a checkpoint can check if modifications are disclosed.

    The RPU do investigate this. Several drivers delivering pizza of an "Indian" type were done for not having valid insurance. Not declaring that you are using the car for business use invalidates your cover. As to the modifications, the RPU lads will call the hotline (each underwriter has one) on Monday or Tuesday and check for disclosed mods. Don't any of you think GDPR stops that happening.

    Gardai are doing roadside checks on window tint % at Rally's this year, and handing out fines and penalty points, they caught 70 cars one Sunday last month

    65% light pass through for windscreen and front side windows. They use a Tint Meter, it's part of the NCT too.

    I know a motorbike delivery guy. Taxi pulled out on to road and wrecked his ankle for years. Motorbike claimed from taxi insurance, motorbike was done for having no insurance as he was delivering fast food. Fast forward 5 years and same guy gets back on bike again. He is immediately stopped and insurance is checked to see if he can deliver fast food. This time it's all good and presumably there is a note on file that he is legit to prevent un necessary stops. May seem petty but plenty of cars about that don't have "real" insurance, where they lie about modifications. I was told an aftermarket radio or new wheels may invalidate insurance and you end up being prosecuted for driving without insurance.

    Have gone to Killarney on the rally weekend for the past few years. There are less lads in RWDs doing rings and more young fellas in diesel Golfs/A4s coo-ing their way around in 2nd gear. They are more of an eyesore than a danger to anyone.

    On the positive side it brings out some great road cars. Saw a Supra Mk4, Rx7 FD, AE86s, a few Chasers/Laurels, Skyline R32/33, a few Evos, Glanzas, different Silvias, all these very cool cars that only get a handful of days out a year.

    Void or voidable insurance is the same as no insurance to the Gardai I'd have thought.

    Yes but there seems to be an element of Gardai doing the insurance company's job if the cars are otherwise 100% road legal. Where do you draw the line, should the Gardai be checking that the persons declared occupation (not talking about change to courier or delivery use) on their insurance matches exactly their current role or that their mileage is exactly as per declared on the original insurance quotation, these are other elements in calculating the risk level of a driver for quatation purposes, same as modifications.

    Nope, you can't be done for 'no insurance'. All that can be done is the policy cancelled and then be blacklisted by all insurers.

    But, as a Certificate under RTA has been issued, you are 'on cover'. In the event of a claim etc, then Insurance company would have to take civil proceedings to recover any monies paid out on the policy.

    Not sure about that.

    Insurers don't go generally go hunting for car modifiers and just rely on the principle of utmost good faith.

    The Gardai know that rallies unfortunately bring out some really bad driving behaviour, so it makes sense to be around such events.

    Just my 2c.

    On tint I had all my windows tinted except windscreen when I was younger and all my cars the past few years had all three back windows done.

    And on tint some guy I met on the road a few times has his front windscreen tinted in a white film with graphics on it. You cannot see into the car. Madness.

    If you go through a checkpoint they do a quick look, if they suspect that something is not correct, they do a check.

    They are not stupid, they know the people delivering food, or have an idea from their movements, its not that difficult to spot the cars, make model reg, they tend to be the same few in a given area, they may see the same driver several times with a takeaway bag on the seat before asking.

    While I'm in agreement with tints on the front half of cars being a safety issue, especially at night I don't understand why certain unmarked Garda cars are allowed to have front tinted windows. Guards eyes are no different to everyone else.
