    The judges in this country are a disgrace.

    They should have no input to sentencing.

    The TLDR of the entire Kentanji Brown Jackson confirmation hearing series: judges pass sentence passed on the sentencing guidelines by the legislature, usually to some standard which reads something to the effect (at least in the US, presumably in other western democracies as well), that the sentence shall be "sufficient but no greater than necessary."

    If the people don't like how sentences are being handed down, they need to go to their legislatures and demand new legislation imposing renewed sentencing guidelines.

    I agree, but the judge could have imposed a custodial sentence.

    This is not the case in Ireland. It should be, but it's not. For example, the only real mandatory sentence is for murder. There is s15A of the misuse of drugs act with has a 10 year sentence for over €x in drugs but it is ignored by the judiciary. We need to introduce sentencing rules for judges to follow. In fact the Law Reform Commission said when commenting on the US system "In our Consultation Paper we [...] recommended against the introduction of presumptive guidelines and we adhere to that recommendation."

    This is part of the problem, who do I vote for if the judges are soft on crime? They are unaccountable for this.

    Slightly misleading, this teen isn't the one who pushed yer one under the train. He was part of the group. He was gone past the girl before she was pushed. He did kick someone in the head from his bike (just before the girl who was pushed), no injuries. Didn't like that he pleaded not guilty, but I'm sure that was taken into account. 6 months probation and possibly face jail if he reoffends.

    Now, separately, that still isn't enough imo. No message sent here. Apparently he was "self-medicating" with cannabis. Didn't know smoking joints is considered self medicating these days... Only when you're up in court I suppose! Allegedly has removed himself from the group. All sounds well and good, let's hope it stays that way. Don't suppose we'll ever know if he re-offends though. Hopefully not, a positive outcome would be nice for once.

    The lad who pushed the girl is up in the Circuit Court in the future.

    He wasn't the one who pushed the girl over the platform.

    How this fúcker on the other hand didn't get a custodial sentence is an absolute genuine mystery.

    The Justice Industry, and make no mistake it is an industry, makes most of their money from repeat offenders. There is no money in legal fees if criminals are in jail. Some lad who has 100 convictions is a cash cow for the defence and prosecution teams.

    There'd be far fewer cases for them to make all their money if there wasn't a load of touts.


    Seriously though. There are backlogs anyway in the courts. If they locked up everyone that appeared in court, there still wouldn't be a shortage of cases coming to them.

    Have you looked at the legal aid fees? Barristers are leaving like rats from a sinking ship. I'm critical of our soft on crime approach but we don't need to resort to making up conspiracies that judges (who are paid a salary) are conspiring to release criminals so the reoffend so that their former colleagues can earn a few hundred quid.

    put kids in jail and all that does is put them around people with substance abuse users and people with mental health issues who groom them into even worser situations so how is that a good thing? they tried putting everyone in jail in america and look how that turned out

    I'm sick and tired to hear the deprived area and rough upbringing excuse. How is it fair to the parents who actually raise their kids right, if any of those kids were to make a stupid mistake them having decent parents will work against them?

    And no, don't lock young people up when they do something stupid once, or maybe twice. House arrest will do. But from the 10th-20th conviction I would lock them up and throw away the key.

    Except the youth was not charged with that offence, another youth was. And the judge point out from the CCTV that the youth was not involved in that act.

    You remind me of Lord Denning... the judge who was not particularly concerned if the Birmingham Six were guilty or not, since the probably committed another crime in any case.

    Your title on this thread is a blatant lie, since the youth being sentenced was not the one who pushed the teenager on to the tracks as was evidenced on CCTV, commented upon by the judge and documented in the link you posted.

    The youth, who faced sentencing today, made physical contact with the witness as she tried to get to the train. However, the judge noted that he had gone past when the second girl was knocked under the train.

    Now I'm not happy about what happened, but I'll take learned judge's opinion over the ranting of someone who clearly does not know who justice must be applied any day.

    There will be no change in the ridiculous sentencing laws in this country until somebody goes full Gerard Butler from Law Abiding Citizen, and then gets prosecuted themselves.

    Is anyone really surprised at this judgement though, really? Another day another pathetic judgement that sends a clear message to scumbags in this country that they can do as they please and get away with it. The judge should have hammered this guy, sent him to Oberstown for a spell. The fact that using illegal drugs to 'self medicate', nice way of his defence to get rid of the druggie aspect of the case, could be used as a mitigating factor is disgusting.

    The Judiciary doesn't work in the interest of justice, it operates to provide a revolving doors policy of serial offenders providing work for Solicitors and Barristers. The fact that we can do nothing about Judges to remove them from the Bench when they are a problem doesn't help. That poor girl and the other people caught up in that violence will have left the Court with no justice whatsoever while the scumbags laugh at the Courts and no doubt get wasted and stoned with their equally scuzzy friends and family today. Probably on Social Welfare so that'll pay for his dope habit.

    Free legal aid no doubt. Allow 1 free legal aid per year, to keep the bleeding hearts and those idiots in the Irish Council for Civil Liberties happy, then these people might get sentenced.

    Judge Martina Baxter said: “He waited 18 years to assault -with particular brutality- the victim. He lay in wait 18 years and assaulted not once, not twice but three times.

    “I find this particularly reprehensible."

    She then uses the word "chilling" in her summation.

    Yet our boy walks away with a suspended sentence because he showed "remorse" (snigger), got a few letters signed (parish priest no doubt amongst them), and paid a few quid to the victim.

    Lovely **** country.

    You seem to pop up on lots of threads with this type of stuff , Lisa Smith in ISIS: leave her alone, the poor woman had mental health issues.

    3 year old hit by a scrambler bike: there's not enough scrambler tracks for the young people.

    The recent brawl in Dublin airport: "probably addiction issues or mental health, hope they get the help they need".

    As other have mentioned, its not a choice between letting them go or locking them up in a cell in an adult prison with Hannibal Lector.

    Feral teens with a reputation for trouble in the area who knocked a girl under a train need some sort of custodial treatment, they've proven that society needs to be protected from them.

    yeah well I think you want to go back to the days of coporoal punishment, if someone has a problem and takes a wrong turn maybe we can get those things they put the head and hands in set up in town again and people like you can throw cabbages at them
