What is this? You mean the Donald is putting out false statements that are wrong and bear no relation to reality? Surely not!

  • Registered Users Posts: 2,918 ✭✭✭Tippex

so He's under investigation for violating the espionage act

    and

18 USC 2071 — Concealment, removal or mutilation

18 USC 793 — Gathering, transmitting or losing defence information

18 USC 1519 — Destruction, alteration or falsification of records in Federal investigations

Trump apparently leaked the warrant to Breitbart. The DOJ had sought to redact or shield the names of agents involved. Trump took no caution. The Breitbart article has names of agents, which obviously puts a target on their back. Reprehensible. Trump needs to be stopped. Enough. (this is from a tweet)

Oh and lets not forget that Trumps Lawyer was on Fox telling everyone that trump etc were watching via the CCTV during the search (no sure how they could have planted stuff)

so they have formally agreed to it (but apparently trump released them to Breitbart earlier today)

I thought Former Presidents were still entitled to classified material? George Bush senior was very big into receiving top level Intel briefings when out of office.

So.... not in a country club?

I'm presuming Trump's claim that all the documents were declassified is akin to Michael Scott declaring bankruptcy in The Office by just shouting "I DECLARE BANKRUPTCY"

  • Registered Users Posts: 2,918 ✭✭✭Tippex

    this is getting juicy

some of the classification of the docs

SCI basically means they are to be read in a scif so certainly not in a resort in palm beach

  • Registered Users Posts: 2,918 ✭✭✭Tippex

    yep pretty much.

I seen something earlier that someone was saying that as the president has ultimate say that he can essentially say in his head I'm declassifying these and not actually need to tell anyone (yes we know this is horseshit but apparently this was from someone in trumps circle)

Seeing tweets that Trump (or his team) sent a copy of the warrant to Brietbart, but without redacting the FBI agents names that are on it. If those names get out there will likely be threats made against them.

The king of whataboutery strikes again! Which interestingly enough, is an old Soviet propaganda tool.

  • Registered Users Posts: 83,033 ✭✭✭✭Overheal

The information he reportedly took includes SCI

SCI are documents that are specially compartmentalized. They are not scanned or copied, they are not stored electronically. The Nuclear Energy Act provides that no POTUS can unilaterally waive SCI classification on nuclear secrets. Ergo, the DOJ can exhaustively demonstrate that 1) Trump had these documents checked out 2) They were never returned 3) they were never decompartmentalized or declassified 4) they were found in the search of Mar a Lago.

Why do you think they did it? They have already used violence, intimidation, insurrection and even murder, GQP 2022.

  • Registered Users Posts: 5,302 ✭✭✭PropJoe10

They retain their security clearance but a) they don't need to have access to this stuff, which is a requirement to access it and b) they're certainly not entitled to keep it at their country club in Florida.

So ABC news has just said that Biden had removed Trumps security clearance when he took office.

This is huge also that he had not right to ANY of the documents.

    The statutes behind the Warrant

    § 2071:

(b)Whoever, having the custody of any such record, proceeding, map, book, document, paper, or other thing, willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit his office and be disqualified from holding any office under the United States. As used in this subsection, the term “office” does not include the office held by any person as a retired officer of the Armed Forces of the United States.

(b)Whoever, for the purpose aforesaid, and with like intent or reason to believe, copies, takes, makes, or obtains, or attempts to copy, take, make, or obtain, any sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, document, writing, or note of anything connected with the national defense; or

(c)Whoever, for the purpose aforesaid, receives or obtains or agrees or attempts to receive or obtain from any person, or from any source whatever, any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, or note, of anything connected with the national defense, knowing or having reason to believe, at the time he receives or obtains, or agrees or attempts to receive or obtain it, that it has been or will be obtained, taken, made, or disposed of by any person contrary to the provisions of this chapter; or

(d)Whoever, lawfully having possession of, access to, control over, or being entrusted with any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, or note relating to the national defense, or information relating to the national defense which information the possessor has reason to believe could be used to the injury of the United States or to the advantage of any foreign nation, willfully communicates, delivers, transmits or causes to be communicated, delivered, or transmitted or attempts to communicate, deliver, transmit or cause to be communicated, delivered or transmitted the same to any person not entitled to receive it, or willfully retains the same and fails to deliver it on demand to the officer or employee of the United States entitled to receive it; or

(e)Whoever having unauthorized possession of, access to, or control over any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, or note relating to the national defense, or information relating to the national defense which information the possessor has reason to believe could be used to the injury of the United States or to the advantage of any foreign nation, willfully communicates, delivers, transmits or causes to be communicated, delivered, or transmitted, or attempts to communicate, deliver, transmit or cause to be communicated, delivered, or transmitted the same to any person not entitled to receive it, or willfully retains the same and fails to deliver it to the officer or employee of the United States entitled to receive it; or

(f)Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer—

(g)If two or more persons conspire to violate any of the foregoing provisions of this section, and one or more of such persons do any act to effect the object of the conspiracy, each of the parties to such conspiracy shall be subject to the punishment provided for the offense which is the object of such conspiracy.

    (h)

For the purposes of this subsection, the term “State” includes a State of the United States, the District of Columbia, and any commonwealth, territory, or possession of the United States.

(2)The court, in imposing sentence on a defendant for a conviction of a violation of this section, shall order that the defendant forfeit to the United States all property described in paragraph (1) of this subsection.

(3)The provisions of subsections (b), (c), and (e) through (p) of section 413 of the Comprehensive Drug Abuse Prevention and Control Act of 1970 (21 U.S.C. 853(b), (c), and (e)–(p)) shall apply to—

    (A)property subject to forfeiture under this subsection;

(B)any seizure or disposition of such property; and

(C)any administrative or judicial proceeding in relation to such property,

if not inconsistent with this subsection.

(4)Notwithstanding section 524(c) of title 28, there shall be deposited in the Crime Victims Fund in the Treasury all amounts from the forfeiture of property under this subsection remaining after the payment of expenses for forfeiture and sale authorized by law.
