I’m not sure if this is the right place, and I will see a solicitor about it,.

My question is I was involved in a traffic accident 2 years ago. Completely no blame on me and 100% the other drivers fault.. I had to make an emergency stop to avoid an accident. At a complete stop I was rear ended and suffered whip lash injuries. With physio and neck exercises which I still do,it has , not resolved, but lessened to a degree.

I settled for €10, 000 which I thought was better than going to court. 2 years later I got a cheque in the post for €7,000. I contacted my solicitor who handled the case who said the €3000 difference from the settlement was for their fees . Surely all fees are on the other driver ??

I plan to contact the solicitor who handled other maters for me years ago to explain this to me. And to think I didn’t rat the bitch out when it happened to the gardaí that the DL reg on the Louth woman’s car was the same as her Donegal boyfriend who was driving in convoy behind her coming back from meeting Mammy in Donegal I assume ! What are my options ?

Currently going through something similar, I believe my solicitor told me as PIAB won't be dealing with it due to the extent of my injuries, it will instead be going to court, therefore my solicitors fees will be paid by the other party. I'm guessing you and the solicitor never had a previous conversation about this. I think once it goes through PIAB (think I'm spelling it right), then you have to cover your solicitors fees. Of course I could be wrong.

My god that sounds horrible 🙈 it's mad how much crashes can impact your life years after, it worries me what my body will be like when I'm much older, it only adds to the wear and tear

Talked to a solicitor and if I signed terms I’m shagged . If I did it was only last Friday I did it and so I’ll look for a copy of that .

Normally with the settlement it will say if costs are separate etc to the agreed amount.

If didn’t know that, I , wrongly, assumed that costs were burdened on the guilty party and not the ‘victim’.

No costs will always have to be decided among the parties when it comes to settlements I believe. Generally if it ends in court then the losing side will more often than not have costs set against them as part of the judgement.

Thank. I thought that would have been the starting point in any case where liability was completely on one side
