    I am nearly positive there has to be evidence it’s not of merchantable quality. Ie a mechanics report.

    Yes, both the sale of goods act and the consumer rights protection will cover you.

    Yes, need to show that the car is not as described or as expected for the price, quality etc one would expect NORMALLY of something of a similar price range.

    Need to document the initial complaint to the dealer, this will in effect hold your 30 days.

    Not necessarily a good idea. If you bring a mechanic and he checks the car it's assumed you are aware of any problems with the car

    The bringing of a mechanic in no way stops your legal rights.

    Yes, you will get some smart ars3 who will say it to you to try and cop out, but you are protected by the law

    It's probably more of an issue with older cars than newer ones, where a garage is trying g to limit there warranty to engine, axles and gearbox.

    If for I stance the tyres are bald, their us a dent,electric window not working, soor not closing properly etc, the garage can claim that these were o ivious faults and the mechanic must have spotted them, making the buyer aware and his not pointing them out at time of sale is indicative of him accepting them as part of the sales contract.

    Depending on what the mechanic reviews, the dealer could rely on that inspection as evidence that the fault was not there on sale but developed later. That’s a fairly simple own goal. Personally, I prefer not to have to rely on warranties, bringing a mechanic or having a car inspected should show up potential or likely things. Of course, the fault might not be in an area where the mechanic could assess but it opens the door for the dealer to assert that it was not in place at point of sale.

    Hi all. Got a full refund. Such a relief. I would never buy an English car from a garage again. Apparently these garages are buying cars in the auctions, and fixing them up. The car I bought had so many issues. It's up for sale again anyway, god help who ever gets it. 20 grand.

    i remember hearing about how a car transporter would arrive at a secondhand car dealer at night in Cork would arrive at night with damaged cars and then cars would have disappeared by morning - all sent straight to a body shop

    Great result OP. That’s a huge relief for you. A few years ago I’d see transporters with English cars on them on the M50. Always a couple crashed ones on it too. Obviously still at it.

    Did you ring them and say you wanted a refund under your consumer rights? Was there any push back from them?

    I own a Toyota CH-R hybrid, best car I’ve ever owned, very well made, extremely reliable & trouble free. I think OP’s car has been in quite a bad accident, that MUST be declared at point of sale. The car was obviously not fit for sale without declaring that information and having it fully repaired ahead of sale.

    Delighted. Sounded rough as could be.

    It being an English car is not the problem. There are arguably more checks you can do on uk cars versus irish ones before buying as there will surely be mileage records etc.

    The problem is that you bought a crashed car from a dodgy dealer.

    Buying your next car, you will have most security buying fron a main dealer for that brand. You will pay more but generally should get a reasonably respectable example.

    Kind of crazy how little information you can get about the history of Irish cars. Unlike here, in the UK, you can see full MOT(NCT) history and any crashes are better documented.

    I'd say share the garage, vehicle with reg to warn others. It's not defamation if true.

    Probably but because too many fools that get blinded by excitement when they go to the car dealers and find out that they are getting a supposedly great trade in and can afford the car they really want. They won't do the history check because it might shatter the dream.

    Well done getting your money back. I can imagine the relief walking away from it with your 20grand back in your pocket.

    As others have said though, any car needs to be checked out, doesn't matter if it's UK or Irish. And don't assume it's perfect because its at a main dealer.

    I would agree and say you have the "most" security from a main dealer. Official dealer of a brand.

    But I'll also say I've had mixed 40:60 good and bad experience with such dealers.

    It has not been economical to import cars from the UK since Brexit. VRT and emissions import tax have added significantly to the cost. The gap in price between Ireland and the UK have closed as well. The only reasonnto import now is to buy a specification that is very hard to get in Ireland.

    I was checking out a 2014 or 15 Toyota Rav 4 2.2 D in the UK last Autumn. The car were 9-12+k sterling which was 10.5-14k euro. Import duty was another 6-7k euro if I remember right. Add in sourcing costs at 6-800 euro and the car would cost 16-20k imported If you found one in Ireland you would buy it for 14-15k euro

    If dealers import cars and are selling the car even at the same as Irish prices they are losing significant money on the transaction.

    Where they win with damaged cars is the import costs are significantly cheaper and they are probably buying cars that are not economical to repair in the UK

    Glad you got a refund OP, but it's uncomfortable to see the car is back up for sale again. Perhaps they fixed it?

    Just wondering did you do a HPI data check or a carVertical report before purchasing? They are essential for any UK import imho.

    good result and garage really had no option. They have probably got if fully checked and fixed the issues. Even the worst lemon can get fixed up once the mechanic knows what the issue is.

    I would not go against UK cars. Usually they are far better specked and better looked after than cars here. Most are former lease cars and they get sold at 3 years. Leasing companies generally use auctions to sell vast numbers of cars in a day. Possibly this was a former car rental car, or simply the driver did not look after it well.

    When I buy second hand cars it would be from a main dealer, and I always ask if the car has a full service history. My present car was bought new, but several previous models came with a folder of a full service history where I could see car had been serviced consistently and where it was done, and any interim repairs etc. Of course it doesn’t guarantee anything, but when you see car has been regularly looked after it’s a good sign.

    You might want to educate yourself. That's quite a lecture and completely untrue.

    For registered motor dealers with Tan number etc, it is perfectly easy and profitable to bring in uk cars. They claim back uk vat and pay irish vat. Duty is 10 percent of uk invoice however is not required in all cases.

    In addition to this, a dealer can now pick up any uk car whether vat qualifying or not as the non qualifying one are now entitled to a rebate from uk revenue of 1/6 uk invoice Price.

    You are making quite a statement to say that only dodgy cars are now worthwhile from uk.

    What you are confusing is the ability to access the uk market for private buyers. That no longer makes sense as basically you end up paying vat in uk and Ireland.

    Dealers are bringing in cars by the lorry load daily. Auction prices are also through the floor in uk for more high end stuff so even more opportunity to import.

    I did a full check. The car checked out completely normal. If there has been no insurance claim, the car will have a clean record, I didn't know this. The passenger side of the car was crashed and repaired. The hinge on back door were different, the petrol cap was one you buy in Halfords. The door had something missing, a crash bar or airbag. The heating system was broken. A nightmare, clips missing under both wheel arches.

    This experience has really opened my eyes about buying a car. I'm a bit nervous about posting the ad, I will send it private if anyone wants it. I had murder with the garage

    I’m looking for a car for my 21yr old son. At this stage I’m gone goggle eyed weary of the process. I’ve a budget of max 5k.

    Last car we were “destined to buy” looked grand but when we did a history check the car showed up as an insurance claim last December.

    We notified the seller of this and asked had he any photos of car before repairs as I’ve no problem with repaired cars once I know what the damage was and that it was repaired right. 15 mins later “Michael” marked the car as sold.

    I wouldn't name the garage, but I would contact SIMI and ask them to check it out.

    If there is a stream of iffy Cat-S motors coming in from GB, it bears closer regulation.

    SIMI membership is meant to count for something.

    No reason not to post the ad. We all post dozens a day to various threads.

    I really want to know how, practically, he got his money back. Phone call and the garage agreed to take the car back and gave him cash or transferred the money straight away on return?

    At least I learned about that 30 day no fault return on goods. Didn’t know about that so not a complete loss of a thread.

    At least it wasn’t that new account dreamer who was popping up every month for a while with his fanciful stories of mechanics refusing to return cars and teenage neighbours mocking his driving skills!

    1) Registered letter with proof of delivery and copy of the letter.

    2) Email to the company.

    At least you have proof.
