Japanese import car, no rear fog light, is this legal?

Regarding rear fog lights, are they a legal requirement or not?

I spoke to NCT and consulted the NCT manual 2023. They both indicate if the rear fog light is not fitted then it is not an NCT failure.

https://www.ncts.ie/media/aidher01/nct_manual_2023.pdf 4.5. Front and Rear Fog Lamps( 4.5.1. CONDITION & OPERATION (WHERE FITTED) )

My question: If a car has no factory fitted rear fog light is there a legal requirement to install one?

Before they were a requirement we used to fit them !

    21Watt ?

A relay fitted to the high beam and a switch to turn on/off

If turned on and the high beam was on then the fog lamp was off

If turned on and the high beam was off then the fog lamp was on

No requirement in Ireland but in the UK you used to see them retrofitted to some Jap imports as it's a MOT fail over there not to have one.

There is a legal requirment for a rear fog lamp in Ireland since the late 90s & it is a failure in the NCT manual.

Whether the tester enforces it it a different matter

    f. Presence and visibility (rear fog lamp). (f). Rear fog lamp missing or not clearly visible.

It will fail only if there are signs that one was there and removed (i.e. there is a switch for the rear but the light is not there). If car was never fitted with a rear fog light it is not a fail. I went through this with my own Japanese import recently.

"Where Fitted" are the key words here.

This is where it becomes open to interpretation. "Where fitted" applies to front fog lights, which are not a legal requirment.

Rear fog lamp(s) are a mandatory fitment since sometime in the 90's. It's in the Irish Statue book same as the NCT manual.

Great if you get going without fitting them but it's not the actual rule. The car is supposed to be tested European standards.

My own Jap import as well as probably about 100 customers of mine have passed numerous NCTs without a rear fog lamp fitted.

If they dont come from the factory with one fitted its not a fail.

Its not a fail in the NCT manual - its quite clearly stated "where fitted" and this also applies to the rear fog light.

Theres no interpretation needed. Its black and white - "where fitted"
