RBZ , Ukranians and letting to the council

    Hello all

    Can I ask for some information or advice please

    I have a house in Ireland which my mother let , managed and kept the rent for 25 years

    She had the same tenant in the house from Sep 2014 to Dec 2023 and she didn't put up the rent

    She no longer is young enough to manage the property and wont continue

    Anyway this year I have taken over. I had wanted to do up the property and let at market rates through an agency as I cannot be in the country

    Just found out about the RBZ. The house is now in a RBZ since August last year

    So since the rent which is about half the market value cannot be put up more than about 8% -10% depending on RTB having updated the rental documents to the correct starting year (which they havent) it is not a viable option to put money into the house and get so low rent. The proposed updates were not an extention or other RTB exemptions but more like a new kitchen , etc

    (BTW had to ring RTB several times to get them to sort out the records, their system, etc . Awful experience )

    Anyway can I get some clarification

    1. if one doesn't rent the property for 2 years then one can go back on the market at the market rents after the 2 years are up with RTB approval?

    2. Not sure if this is an option but if one 'gave' the house to Ukranians under current schemes would that qualify as not rented as one doesnt need to register this with RTB board ? Though not sure how long the Ukranians will stay or if these schemes still an option

    3. If one 'gave' the housee to the council for a certain number of years how would that work with getting 80% of market rates . Does the council give you 80% of what the RTB say you can get or is it actually 80% of actual market rates

    I am thinking of selling but need to clarify these issues before I come to a decision so any help would really by gratefully received

    I bought the house for 65K 25 years ago , after capital gains tax, estate agents and auctioneers fees I could get about 2 times that

    If I had invested the money in the FTSE 100 I would get 2.5 times that . This is about the same if I had left it in a bank at 3% per annum for the last 25 years. And this is much lower than tracking the Dow or other managed investments

    I know there was the income for my mother over the year but it was very little considering tax, letting fees, acc fees, and the hassle

    Why anyone would let a property is beyond me unless of course you are prepared to work at it

    Is this a royal residence?

    Availing of the scheme which houses Ukrainians would seem the best option other than selling, particularly if want to wait the period necessary to increased rent to market rate. It is tax free and no tenancy exists to no need to register the tenancy and you can end the offer agreement easily should you decide to sell.

    You can check if the scheme is still available to new owners by following the guidelines at offerahome.ie.

    Do not rent to tenants if you are considering selling or the rent is way below market rate.

    I'm not sure what you mean Dav010 about royal Residence ?

    Can you please confirm its 2 years of no renting to wait to get back to market rates with RTB?

    Hi MPFGLB,

    Just wondering if you ever got clarification on the issue you had below? in a similar situation myself and considering letting it to Ukranians for the short-term until I can offer at market rate again. Did you get any resolution to your situation?

    The current belief is the government are going to change the RPZ rules so new tenants will not be entitled to the previous rental rate. Probably by January

    I still have the Ukranians though the ARP has just dropped to 600 euros a month.

    I must say the Irish government is run by a bunch of idiots. 600 a month for a family of 4 in a 3 bedroom house is too low and yet 600 a month for one person in your house is fine…why a blanket payment and not a category payment ..Is that too mcuh for their brains to fathom

    My house and the maintenance i have to pay for and the upkeep means 600 a month is laughable, esp given the time I put into every query. but have to continue as stuck with the low rent from when my mother kept the same tenant for 8 years and never raised rent

    Seems if you are a good landlord you are screwed…only the big landlords get all the money

    So will ahve Ukranians till 2026

    I have left what was a rental house empty because of the government rules making it too risky to rent it again. Can't sell it as it's on family land right beside the farm sheds. It's a terrible waste but dealing with entitled and difficult tenants has turned me off being a landlord. I'm noticing a lot of empty houses lately. A lot are where elderly people are in nursing homes. Government policies are causing houses to be left empty.

    If you had Ukrainians in your house fir more than two years you can now charge market rent and aren't affected by the rpz rules anymore. Obviously you would have to ask the Ukrainians to leave and you might not want to do that.

    You don't have to ask the Ukrainians to leave, you can tell them to leave.
