No, just lease it to someone who will farm it.

Only benefit either way is in if the land is transferred before you're 35, you can get stamp duty back.

That's what I suspected. A fella in Teageasc told my Dad I should do it for all these benefits but as far as I can see they only apply if you are farming it yourself.

And unless something drastic happened, I won't have it signed over to me before 35, so the stamp duty benefit is irrelevant. Also, I think I can still benefit from consanguinity relief without the green cert?

Herself is thinking of doing the distance green cert, we're over 40 and I missed a trick not adding her to the herd number years ago, we've 2 more sheds to do so it would pay for itself I'd hope if we got the 60% TAMS grant for example.

Has anyone on here done it lately, from teagasc website looks like its 3K and will take 14 months or so, but there are quite a few Saturdays and with the kids activities she might miss a few of those days so don't want her to get caught if they are strict on full attendance.

I did the Greencert with FarmEd.
5 Saturdays in Tipp over 18months and most other Saturday mornings online for classes or assignments.
Subject matter is manageable, especially for anyone used to farming but it takes time and commitment to complete the modules and pass the course.

Can you avail of the 60% if your Mrs is simply added to the herd number or does she have to be a qualified farmer? Over 40 years old

60% covers all female farmers qualified or not with no age limit as far as I am aware, (OH is in her mid 40s with no green cert and has qualified, it's her own herd number).

I would imagine that their name would have to be on the BISS application for the previous year before qualifying which is normal enough practice for DAFM

No it's separated into different modules, some have exams at the end, some don't, also some practical work done in an ag college too. At least that's what it was like when I did it 8 or 9 years ago. As college courses go it's really not that difficult.

Don't you need to have the green cert done to avoid paying capital gains tax on farm inheritance? e.g farm worth 900K. On inheritance you will pay 30% Capital Gains - minus father to son tax exemption which is currently 400K i.e 900K - 400K =500K * 30% = €150K

If you are the son and plan to farm it or lease or for 6 years, you can write down the value of the farm by 90%.

So you pay 10% in CAT and if it's in the tax fee threshold of €400,000 you pay nothing.

So for the €900,000 farm you would pay €90,000 but you pay nothing because it's below the threshold.

The OP says he is not interested in farming but plan to lease it so say for example the farm is worth 900k as per example.

No Green Cert - on father passing - CAT is 33% of 500K(900k - 400K exemption) = 167k

Green cert - on father passing - value of farm down to 90K as OP has green cert, 90K under 400K threshold = 0.

In conclusion if OP does not do Green cert he\she will have to pay 167K in tax as opposed to 0 if he\she does green cert.
