Getting compensation for personal injury from fall

    Three weeks ago I sustained a fall in a pub. I was coming out of the toilet when I slipped on a wet patch on the stairs. I fell on my back and sustained injuries (cracked rib as well as muscle and tissue damage in my back). I spent a night in hospital and racked up medical bills thanks to the accident. I was in contact with a Solictor and he told me that I had a good case to claim liability from the owners of the pub. As you can imagine I was in a lot of pain and discomfort up to now but I have been recovering from my injuries. It will another 2-4 months before I am back to full health.

    I got a phone call last week from an insurance company who deal with the licensed establishment and he called over to my place. He then upfront admitted that his client did not want to go to court and wanted to settle any compensation case including any compensation for my injury. Straight away that was admitting liability on their part and that they would not be contesting any claim on my part. He took copies of my medical bills and asked me how much money would be satisfactory to me. I told him that as well as paying for my medical fees I would expect some kind of decent compensation claim to cover any future medical costs (physios) as well as the pain and discomfort that I have had to endure. I told him that I cant go to the gym, run and I haven't had a decent night's sleep in weeks. The insurance guy will get back to me this week with an offer. I am willing to settle out of court and I do not want to incur any legal fees or engage in a lenghty legal process that could take years. I'm going on holidays very shortly. I would be grateful for any advice and possible compensation to expect. I wish to stress that I am on the road to recovery and the pain is easing.

    If they're accepting liability then you're probably better off keeping it out of court anyway, depends on how much the hospital bills are and if you've incurred any loss of earnings from being out sick, or will miss work, your solicitor should be able to give you a better idea I'd imagine.

    Don't give/ request medical or professional advice

    If you want to tell someone about the amazing results YOU have had with a certain medical treatment, then go ahead. What you can’t do is tell them that THEY should have that treatment. You aren’t a doctor. Even if you were, you haven’t examined that person physically, nor do you have a full medical history. This applies to Alternative/Complimentary medicine too. Suggesting to someone that has a serious problem that <insert alternative therapy here> might cure it is very irresponsible.

    Don't diagnose anyone on the site either. You simply can’t and we don’t want you doing it. Don't do it.

    Don’t request medical advice or diagnosis. If you have a rash somewhere naughty, your head is hanging off or there is green goo oozing from somewhere GO TO A DOCTOR.

    Randomly asking people online what’s wrong with you and what you should do about it is about the DUMBEST THING EVER. You deserve your place in The Darwin Awards if you follow any advice you get. We disclaim ALL liability if you are stupid enough to listen and act on anything you are told here. GO TO A DOCTOR. A *REAL* ONE.

    As with medical advice, requesting and acting upon Professional Advice bases on something someone's said here without having the specifics of your case in front of them is a really bad idea. An accountant cannot do your books over the internet, nor can a solicitor represent you in court, so for your own sake, if you find yourself in a position where you might need professional advice, please seek it from the right places. Again, as with medical advice, we disclaim ALL liability. We're happy for people to ask general questions about the best way to respond to a letter you may have gotten, be it from the Revenue Commissioners or from an Architect in relation to hte extension you're planning on adding to your house, but you will need to get proper advice on these matters.
