Imagine Broadband, €100 cancellation fee charge

    Right here goes, Achem!!

    Have been with imagine since last may but upgraded to Wimax last week for faster speeds.

    Phoned Imagine today cuz the wimax service that i got last thursday wasn't working properly eg, they didn't tell me at the time but it doesn't work properly with Iphone 3gs and 4(they say its an issue with apple) and i have had problems getting onto lots of internet sites. I have had numerous conversations with their IT people with no joy, mainly no replies when they said they would look into it. This afternoon I phoned to cancel my contract. Long story short, after speaking to a customer care manager who told me that he would wave the cancellation fee of €100 cuz of the 7 day cooling off period. I said that I would be happy to stay with them and continue the old contract cuz, all be it slow, it worked. The cust care mgr wanted me to pay for a dodgy wimax service until the old broadband service got up and running in 3-10 days. Also he said i would have to enter into a new 12 mth contract. I said why should I pay for something thats clearly not working properly and why enter into a new contract when the old contract should come back into effect but he said no, i would have to sign a new contract. I told him i was now going to shop around and I would call back to discuss cancellation. When I called back not more than a half an hour later he told me that Imagine were going to slap a €100 cancellation fee on the old broadband contract that they themselves cancelled when I joined Wimax.

    Can they do that, Imagine cancelled the contract that I started last may when I joined Imagine Wimax, I cancelled the Wimax contract within the 7 day period allowed. Are they allowed penalise me by charging me for a contract that they had themselves cancelled????

    Any advise here would be great, can't afford €100 but after this and their awful service I want rid of them :mad::mad::mad::mad::mad:

    He verbally over the phone today told me that the broadband contract was cancelled when I took out the new 12 mth contract for the Wimax

    Best place for you to take this up would be comreg/some enthusiastic consumer rights type body/joe duffy well not joe duffy to be fair - but you might have some joy by threatening them with the first and annoying/shaming them with the second.

    I lodged a complaint with comreg today but it was before he told me about the €100 fine, i'll call the again first thing
