New second hand car and dealer won't fix

    Hi all.. Looking for some advice.
    I bought a car off a dealer 6 weeks ago, only had it 3wks and the turbo went which he fixed. Was driving it yesterday and d engine suddenly started to go and I barely made it home. Said on the dash it was low oil pressure but the oil was fine. Called the dealer today and he said he wouldn't help even though it is still within the 3month guarantee, said it would have to be major engine trouble for him to fix it. Said he'd take the car back for a 1000 drop in price, no way. By the sounds of it il have to get it fixed myself, hope its not too much. Should I just leave it or take him to court for the price it costs me to get fixed?

    Read your warranty. What does it say is covered?

    You need to find out what is covered under the warranty you got from the dealer. You also need to find out what exactly is wrong with the car now as it sounds odd that a dealer would refuse to fix it via a telephone conversion without even looking at the issue.

    If it is a failure of a component covered under the warranty and the dealer refuses to honour it then you may be able to take him to the small claims court.

    The guarantee is on his website for all cars but there r no terms. He did say on phone I had a 3month warrantee. Surely if something is wrong within 6wks he has to fix it? I thought u had a come back from buying off a dealer otherwise what's the point

    I'm more annoyed about him saying he would take it back with a price drop of that much.

    A warranty could and does have limits or terms & conditions attached to it. Read the small print.

    You first need to find out what is wrong with the car.

    It just says warrant, there's no terms with it. I'm going to call a mechanic tomorrow to have a look at it to see what's wrong and see then will he pay.

    As a dealer myself I suggest you call the dealer on a non bank holiday and explain the issue again, explaining that you do believe to be under warranty and you deserve and demand the car be inspected. Don't drive the car again until you speak to him.

    Is it a 140bhp diesel car?

    Haha! I don't answer my phone on bank holidays!

    The reason I asked about the vag engine is there could very well be a big issue and the dealer may rue telling the op to sod off...

    And op, the word warranty in itself is useless. The word must at least be in a sentence, stating what is covered. Length of time is not the question in this instance. I wouldn't come down too hard on the dealer yet, if he did the turbo free then he's not necessarily going to run away or leave you stuck.

    Unless you are the litigious type, give the dealer an opportunity to diagnose the problem.

    It's Peugeot 307 1.4 diesel it 90bhp.

    He's from up north so it's not a bank holiday and first he got a women in his office to call me back saying it wasn't his problem. He wasn't even giving me a chance

    the only part of the car that is not covered by warranti is the cluch if he does not fix the problem no matter how big or small take him to the cleaners ps the way the dealer said to bring it back and he will give you less money for it he mite have knowing there was something worng with the car in the first place

    I'd say he full well knows that there's something wrong with the car and the way he was so quick to offer taking it back at a lesser value then I'd bet it's not the first time that car has been on and off his lott.

    Have a look at your receipt it'll usually say engine and gearbox 3 months or somethin along those lines. Being a Peugeot there's a good chance it's an electrical fault.

    Is there a DPF on those cars it may well be blocked and they can be pricey to replace.

    Either way you'll need to find out what kind of warranty you have on the car and what the fault is. The fact that he's taken it back once already he's after accepting some kind of warranty on the car.

    When I called I got his receptionist who called back saying it wasn't his problem, talked to him after and he was still talkin along them lines. I'm going to call him after the mechanic checks it and see what he says. If he doesn't pay il take him to the small claims court.

    You can get a mechanic to give it a good check before you buy it.. And 3 weeks later it could bugger up...
    Dunno what the law is about warranty in the north .. Or if you can use their small claims court ect.
    Hopefully yr mechanic will tell you it's something small and everybody will be reasonably happy...

    I actually did get a mechanic to look at it a few weeks ago and he said it was perfect, u just never no I suppose. No I don't live up north

    Take him to the cleaners, small claims court is the right thing to go for. Judge will side with you in this situation. Since the dealer said its under warranty for three months, he will have to fix it or give you near full price of the car back

    He said she said. If he doesn't have it in writing he's got nada and the judge will more than likely side with the garage as he's repaired it once showing an act of good faith you buy a second hand car you're rolling the dice on how good it is.

    Not to mention the fact OP got a mechanic to check it out himself and it was "perfect" according to the op

    It would certainly be interesting to know.

    How do you go about taking a case to the small claims court (or equivalent) in NI when you are not a resident does anyone know?

    Depending on the warranty, being a NI dealer its more than likely a 3rd party warranty, there may be a limited number of claims allowed. You've already made one engine claim so the warranty may be used up. The fact that you got no details doesn't help.

    Our Sale of Goods act would cover this does the UK have anything as consumer friendly? Which is the reason why I don't worry about the length of a warranty when buying here. You need to contact the European Consumer Centre for cross boarder issues.

    i called a mechanic. he said it would cost €200 to strip the car but by the sounds of it the engine is fcked. i called back the dealer, he said to bring it back to him and he will look at it. i just want my money back at this stage. my father in law is going to ring his lawyer and see what he says. hope this works out, what a pain :(
