Hasn't it always been the case where making racist/xenophobic comments online is legally the exact same as publishing them though in the eyes of the law?

I think so, yes. But I'm sure they can be used as evidence (if I start posting anti Roma stuff adn then beat up someone, it can be used against me).

As someone who has a dim view of racism/derogatory comments/ignorance, I have to say that I'm pretty OK with this.

I love the way it's called a "private members site". It makes boards.ie & Politics.ie seem exclusive

    Don't do that OP.

For a second there I thought my mind was soon to be referred to as Exhibit A.

Romaphobia (of the Vatican variety) is ok though.

So, freedom of speech & freedom of expression, as guaranteed under our constitution, is now subject to popular opinion only?!

Have you actually read the Constitution, if you had you would see the humour in your post,

"6 1° The State guarantees liberty for the exercise of the following rights, subject to public order and morality:

i The right of the citizens to express freely their convictions and opinions.

The education of public opinion being, however, a matter of such grave import to the common good, the State shall endeavour to ensure that organs of public opinion, such as the radio, the press, the cinema, while preserving their rightful liberty of expression, including criticism of Government policy, shall not be used to undermine public order or morality or the authority of the State.

The publication or utterance of blasphemous, seditious, or indecent matter is an offence which shall be punishable in accordance with law."

The "right" to freedom of opinion and expression in Ireland has been under the 1937 Constitution a restricted one.
