SH car private sale yesterday

    Bought a sh car Wednesday night, collected it Thursday morning. The car has a serious oil leak that hasent been located yet. What are my options here , I really want my money back........ what would you advise. My car is not driveable now and I need it Monday morning for getting children to school. This car passed the NCT 26/3/14 and I bought it the same night .

    Op, it is just madness buying a used car especially from a private sale, without having a mechanic inspect it first. You are leaving yourself open for trouble and with a private sale you have no comeback. A fresh NCT does not guarantee that the car is mechanically sound either. If you want comeback I'm afraid you need to buy from a dealer who gives you a warranty.

    You need to have the car examined by a mechanic to trace the oil leak. It might be a simple fix, it might not but either way you will be stuck with the bill and for goodness sake in future have a mechanic examine any car you are interested in buying before you buy it rather than afterwards.

    You really should have checked for any oil leaks as a minimum. Suggest getting a known mechanic to inspect first and see what problem is. Could be a simple fix.

    Then ring the seller and explain the situation. May be that they weren't aware of the issue and may sort it for you.

    What car/year is it?

    You paid for the inspection??

    Its ok to look over a car yourself if you have an idea what to look for but if you don't its pointless..

    If I sold a car today and the seller rang a few days later looking for me to pay for something that went wrong with it I would run them.
    Car has nothing to do with me any more. Just the same as if I bought a car off you and it blew up in a few days I wouldn't ring you expecting you to repair it.

    I have spoken to the Gardaí about this matter. It is going to cost me money to get this car sorted, and hopefully wont cost too much.

    The person who sold car to me is operating as a car dealer and IS on benefits so is robbing our state of money :eek:

    this Guy is involved in other crimes and convicted of them ....so is well known to the Gardai

    Can a car be NCT without tax ?

    tbh would you not have been better off stalking/investigating him BEFORE you bought the car?
    & there is about 300 fcukers "working" in Kildare street who are robbing the state so I don't really think that argument holds much water :)

    I have spoken to the Gardaí about this matter. It is going to cost me money to get this car sorted, and hopefully wont cost too much.

    You said it was a private sale. If you bought it from a car dealer, then you do have rights, you'll have to pursue them through the Courts if they wont fix the car or give you your money back. Good luck with that though, by your description of the guy.

    First lets be clear here with fact, is the seller a "registered" dealer or just a guy selling cars on the side? If he is a registered dealer or motor trader then you may have recourse with him via your rights under the Sale of Goods act. If he is not registered as a dealer or motor trader and selling cars as a private individual then it is deemed a private sale and you have no comeback. Given that you say he is on state benefits then most likely he is not registered as a dealer or motor trader and just sells cars on the quiet.

    Personally, if he is known to the Gardaí as being involved with criminal activities then he sounds like he might be the type of person you don't want to be chasing to fix an oil leak. It could bring more trouble that it is worth. I'd draw a line under it and get the leak looked at.

    I'm not sure a Dealer has to be registered for your Sale of Goods Act rights to apply. However I also get the feeling it would be a waste of time chasing this guy....

    Cut your looses. As even if you do get a judgement against the person I doubt they'll pay up and they do have your name and address!

    I didn't say he got ripped off. My point is what exactly do you expect a mechanic to check for?

    He has no magical powers. He can check basic items but not a huge amount else IMO.
