Seperation and Occupancy Clause

    HI.

    My Husband and i built our home on family land 3 years ago , the occupancy clause in our planning paperwork states we must reside for 7 years .

    I can see how this is feasible for either myself or my husband for next 4 years and neither can afford to buy out the house form the other

    No Children are involved and we are anxious to get all resolved

    does any one know is there any success in appealing this clause with my local authority

    Send request in writing to LA is the way to do it. Ring first to see will they agree to it and what info they require if any.

    I have a couple of years ago. Call the local planning dept and talk to them about it. They are actually decent and know somethings happen.

    I too have seen this clause relaxed in similar circumstances.

    Contact the council and ask them.
